Terms of Service
Operator and contracting entity
Boma Express is a Boma Group service. Unless otherwise stated in a written quotation or agreement, online Boma Express services are offered by Boma International Hong Kong Limited, with operational support provided by the Boma team in China.
Services
Boma Express provides defined supplier verification, factory sourcing/RFQ, inspection, factory visit/verification and managed purchasing services. The scope, price and stated deliverable are those shown on the applicable service page or written proposal at the time of purchase.
Customer information
Customers are responsible for providing accurate and timely specifications, supplier details, quantities, drawings, standards, acceptance criteria and other information reasonably required to perform the service. Incomplete information may affect timing and results.
Verification and sourcing limitations
Verification, sourcing and factory assessment reduce procurement risk but do not guarantee a supplier’s future performance, solvency, legal compliance, product quality or delivery. Findings reflect information reasonably available within the agreed scope.
Inspections and factory visits
Inspections and visits are sampling and observation services performed within an agreed scope and at a particular time. They do not guarantee that every unit, process, defect or compliance issue will be identified.
Fees and payment
Fixed-price services are payable before work begins unless otherwise agreed. Managed Purchase and custom engagements may use fixed, percentage-based or other commercial terms stated in the applicable proposal. Approved third-party, travel, testing, tax or banking costs may be charged separately.
Timing
Turnaround times are estimates unless expressly guaranteed in writing. Supplier responsiveness, facility access, travel, holidays, incomplete information and other third-party dependencies may affect completion.
Confidentiality and intellectual property
Boma uses customer product, supplier and commercial information to deliver the requested service and handles it with reasonable confidentiality. Pre-existing intellectual property remains with its owner.
Liability
Boma Express provides procurement support and risk-reduction services; commercial purchasing decisions remain with the customer. Nothing in these Terms excludes or restricts liability or statutory rights to the extent that doing so would be prohibited by applicable law. Any additional limitation of liability should be stated in a separate written agreement where applicable.
Governing law and disputes
These Terms and Boma Express online service transactions are governed by the laws of the Hong Kong Special Administrative Region. Subject to any mandatory rights or jurisdiction that cannot lawfully be excluded, the courts of Hong Kong shall have jurisdiction over disputes arising from or relating to these Terms or the services. A separate signed agreement prevails where applicable.
